How to Fight a Traffic Ticket in Ontario Without Going to Court

You Don't Have to Just Pay That Ticket

Most people who get a traffic ticket in Ontario assume they have two choices: pay it or take a day off work to fight it themselves in court. There's actually a third option — and it's the one that gets the best results.

A licensed paralegal can represent you at the Ontario Court of Justice for traffic and Highway Traffic Act (HTA) matters. In most cases, you don't even have to show up. Your paralegal handles the court date, negotiates with the prosecutor, and works toward getting the charge reduced or withdrawn entirely.

Why Fighting Your Ticket Matters

Many people don't realize how much a traffic conviction actually costs beyond the fine itself. A single speeding conviction can trigger an insurance premium increase that costs you hundreds — sometimes over a thousand dollars — per year for three to five years. Demerit points accumulate on your driving record and can lead to licence suspensions. For new drivers and commercial drivers, the consequences are even more severe.

Common charges a paralegal can help with include: speeding (including stunt driving), careless driving, failure to stop, red light camera violations, driving without insurance, cell phone use while driving, and licence suspension-related charges.

How the Process Works in Ontario

When you receive a Provincial Offence Notice (your ticket), you have 15 days to respond. You can request a trial, and that's where your paralegal comes in. Once retained, your paralegal will obtain disclosure from the prosecution, review the evidence, and appear on your behalf at the early resolution meeting or trial date.

In many cases, charges are reduced to a lesser offence with fewer demerit points and a smaller fine — or withdrawn altogether if there are procedural issues with how the ticket was issued.

What About Stunt Driving Charges?

Stunt driving (travelling 40 km/h or more over the speed limit in Ontario) carries severe immediate penalties: immediate licence suspension and vehicle impoundment at the roadside, plus criminal-level fines if convicted. These charges require urgent attention and an experienced representative who understands HTA defences. Don't try to handle a stunt driving charge alone.
